It was the weekend of May 30, 2020, a critical point in the anger, promise, and unrest following the police murder of George Floyd in Minneapolis. Yet, despite the extraordinary conditions, something familiar took place: Chicago police blocked attorneys from seeing their clients and prevented detainees from making phone calls as state law requires. CPD had been violating detainees’ rights like this for decades.

Across the city, demonstrators—some of whom police brutalized—were hidden from friends, families, and comrades. When their lawyers called police stations, officers misdirected the calls, hung up, or, as one has to presume from the endless busy signals, just took the phones off the hook. At times, attorneys responding to arrests were physically barred from even entering police stations. On at least one occasion, it took the interventions of elected officials to eventually get attorneys through the door. All the while, police had unfettered access to the people they detained.

These nights, and others like them, set the stage for change. That June, a diverse coalition of community and legal groups filed a lawsuit that detailed serial violations of state law rights to counsel and phone calls. I am one of the attorneys for the plaintiffs in that lawsuit, #Letusbreathe Collective, et al. v. City of Chicago. Two weeks ago, the lawsuit was settled with the establishment of a historic consent decree that has the promise to end incommunicado detention in Chicago.

Arrestees in Illinois have long had statutory rights to consult with attorneys in private and to make phone calls from the police station, but in practice these rights have been aspirational at the point of arrest. The new consent decree will help: it ensures that people in custody are able to call family and attorneys within three hours of being taken into custody, among a host of other changes to police practices, including installing phones in interrogation rooms and posting information about accessing free attorneys in areas where detainees are held. The consent decree also provides for data sharing and police station inspections to ensure compliance, and, best of all, is enforceable in court if the city doesn’t uphold its obligations.  

Since 2017, I have worked at First Defense Legal Aid (FDLA), an organization founded in 1995 as a collaboration between grassroots organizers and concerned attorneys in the wake of revelations about police torture by Jon Burge and other CPD officers. FDLA’s goal was simple: end incommunicado detention, and stop false and coerced confessions in the city, by educating Chicagoans about their constitutional rights and making free legal counsel available 24/7/365 to individuals in custody anywhere in CPD’s sprawling network of police stations, detective areas, and investigative facilities.

Although FDLA transferred responsibility for free, 24-hour station house representation to the Law Office of the Cook County Public Defender in 2019, my experiences trying to access clients prior to the changeover have stuck with me. Traveling to police stations at all hours of day and night—most often after a call to FDLA’s hotline (1-800-LAW-REP4) from an arrestee’s concerned family member—I was and remain struck by how consistently, and nonchalantly, CPD violated people’s rights. Chicago police regularly hid clients or attempted to interfere with representation through a potent combination of cruelty, pettiness, and impunity. On any given night, officers could be found denying that someone was present at a given station, refusing to let attorneys see them, or otherwise obstructing efforts, all while their colleagues laughed and carried on in the background.

Detainees and would-be clients reported that police discouraged them from signing the CPD form that initiates a legal consultation, whether by saying that it “makes you look guilty” to want an attorney, that detainees would go home faster if they didn’t see a lawyer, or that because the representation was free, it wasn’t worth having. Further, access to phones, when granted, was and has remained a mess. For example, a Spring 2020 survey of individuals in bond court by the Public Defender’s Office indicated nearly a quarter of people there were never offered a phone call while at the police station, and that the average wait time among those who did get access was more than four hours. None of this is what the law requires.

It is deceptively easy to look at an arrest as an isolated point on the more or less linear—if protracted—progression of a criminal prosecution. Someone is accused of a crime, arrested, and then prosecuted, a process that can seem defined by the critical point of a verdict (whatever it may be), a dismissal, or a plea bargain.

But for the people held incommunicado, the arrest itself and alone has catastrophic reverberations. When you can’t call your mother so she can give your employer a heads-up that you’ll miss your shift, you get fired. When you can’t contact your partner to pick up your kids from school, your family could face scrutiny from child protection agencies or reproach from teachers and administrators. You wonder if your car is getting towed or if your family is beside itself with worry. You wonder if you’ll be framed. Or killed. When you can’t speak with an attorney, perhaps you, like so many others, give a false confession during the 48-72 hours police may hold you without charges, are wrongfully convicted, and spend decades in prison.

The damage of incommunicado detention is not limited to the detainee. Outside of the station, family members, friends, and loved ones are faced with the agonizing proposition that someone close to them has disappeared. Maybe you know your loved one has been arrested; maybe you don’t. In any case, incommunicado detention violates the bonds of community that enable healthy and secure societies.

The efforts of the plaintiff organizations in #Letusbreathe v. Chicago have created a seismic shift, to a world where there is a meaningful route to ending incommunicado detention in this city. While the legacy of the 2020 uprising remains in careful balance, one change is now set in stone—people arrested in Chicago are going to get access to their lawyers, and to phone calls, and if they don’t, the city will be held accountable.

How the Bears and Justin Fields are building balance with their pass game

No one runs more than the Bears, and that won’t change anytime soon. Their 60.2 percent run rate is so much more frequent than any other team in the NFL –the Falcons rank second with 54.5 percent — that the Bears can be guaranteed of holding onto their crown through at least Halloween.

Sunday, though, was the Bears’ biggest step toward building balance.

Justin Fields is starting to resemble a modern quarterback driving a passing attack that, although it’s no one’s idea of futuristic, doesn’t seem trapped in the past the way it did at the end of September.

Over the Bears’ first three games, passing accounted for 29.6 percent of the Bears’ total yards. In the last two contests, 60.5 percent of the Bears’ yards have come through the air.

In the first three games– against the 49ers, Packers and Texans –the Bears threw on 28.3 percent of their downs. Against the Giants and Vikings, they’ve passed 40.2 percent of the time.

They’re not doing their best impression of a single-wing offense anymore.

“I just think it’s growing,” coach Matt Eberflus said Monday. “The guys are growing. The players are getting used to the scheme. The timing’s getting better, the rhythm’s getting better. ….

“You can feel Justin comfortable where he is right now in the offense.”

That cuts both ways, Eberflus said. With each passing week, the new coaching staff is learning how to best prepare the offense for the quarterback, learning “what guys are good at, and really playing to his strengths.”

The last few weeks, Eberflus said he’s seen Fields “taking command” at practice, telling receivers when their route depths are wrong and explaining to them the way he wants things done. Chicago has heard that line before — Mitch Trubisky was the king of Thursday back-field practices — but Fields is starting to transfer that comfort level to game day. He said after Sunday’s 29-22 loss that he felt as relaxed as he had all season. His 118.1 passer rating and 71.4 completion percentage were the best of his career, and his 208 passing yards was the fifth-best effort he’d given in 15 starts.

“I just felt poise, and him calm and confident back there,” Eberflus said.

Sunday’s pass-happy performance — by the Bears’ lowly standards — wasn’t a result of the team chasing points, either. The Bears were within at least one score of the Vikings — or ahead of them — for all but four-and-a-half minutes of the second half. Fields went 12-of-13 for 135 yards, one touchdown and a 135.5 passer rating in the second half

“To have that balance is good,” running back David Montgomery said. “It helps in the run game, and the run game helps the pass game. It helps in all facets of the game. You’ve got to be able to do both. We’re trending up to getting better in both.”

Not that anyone will mistake them for the “Greatest Show on Turf” Rams. Entering the Monday night game, NFL teams have thrown passes on 54.4 percent of their plays. Under first-time play-caller Luke Getsy, the Bears pass 39.8 percent of the time. That doesn’t count called passes that result in Fields scrambling or the quarterback getting sacked. The last two games alone, Fields ran on 13 called pass plays and was sacked eight times.

The pass game is becoming competent, which gives Getsy options. That, in turn, gives Fields a more honest chance to show the Bears what he can do — which is the entire point of the rebuilding season.

“You want to have balance, but you want to take what the defense gives you. …” Eberflus said. “It’s important to have all those weapons in your offense. We’re growing in that way, and we’re starting to see the benefit of that.”

Jed Hoyer: Cubs will be ‘aggressive’ filling holes ‘in the best way’ this offseason

Jed Hoyer described it as a “great feeling” to hear Cubs chairman Tom Ricketts say the president of baseball operations has the flexibility to use financial resources how he sees fit this offseason.

“If we get to a place where we ask for a significant amount of money or to sign one player or several players, I have no doubt that we’ll have his blessing,” Hoyer said during his end-of-season press conference Monday. “And I have no doubt the resources will be there.”

Don’t expect, however, a total reversal of the Cubs’ offseason approach from last year, when their big acquisitions were outfielder Seiya Suzuki (five-year, $85 million deal contract) and Marcus Stroman (three years, $71 million).

Hoyer fell back on familiar tropes from a year ago. The Cubs are going to focus on “intelligent spending,” for example. Keep that in mind when the club is mentioned in speculation about top free agents like Aaron Judge, who reportedly turned down a seven-year $213.5 million extension offer from the Yankees.

“I want to build on the momentum that we created at the end of the year,” Hoyer said, “but I know that we have some holes to fill, and we’ll be aggressive to try to fill those holes in the best way possible. And I think we can definitely compete next year. And we also want to create something lasting and special.”

The Cubs can take steps toward those goals even before free agency opens after the World Series.

When asked if the team had broached extension conversations with players like Ian Happ and Nico Hoerner – who are entering their last and first years of arbitration, respectively – Hoyer said they’ve “taken the first steps.” He then reiterated the club’s policy against addressing extension negotiations while talks are ongoing.

“Certainly there are players we’d love to keep in a Cub uniform for a long time,” Hoyer said, “and hopefully we can work hard on those and get some across the finish line.”

The Cubs also have several impending free agents who they could bring back.

Hoyer said the Cube will extend a qualifying offer to Willson Contreras. The veteran catcher is expected to turn it down. They also have a pair of veteran pitchers, Drew Smyly and Wade Miley, who Hoyer spoke highly of Monday.

“With both guys, in the right setup, we’d love to have them back,” Hoyer said. “They both have a really positive impact on the organization. And there’s no finish line when it comes to adding guys that can make starts in the big leagues and that can add to your culture.”

Further talks between the Cubs and Smyly’s camp are expected this month, working toward a possible reunion next season, according to sources.

While Smyly has a $10 million mutual option for 2023, it’s more likely the parties will negotiate a new contract.

Miley’s situation is more up in the air. He only made nine appearances for the Cubs this year due to injuries and will have to prove that he can stay healthy.

Hoyer maneuvered around a question about where a top-of-the-rotation arm fits into the club’s offseason priorities.

“We’re actively looking for quality innings,” Hoyer said, “pitchers we feel like we can work with and potentially make better.”

The shortstop market also presents an opportunity for the Cubs to improve, potentially moving Hoerner to second base and signing an established shortstop out of another strong free agent class.

“We have total confidence in Nico’s ability to play shortstop, and he proved that this year,” Hoyer said. “But … the game is about to trend more athletic. Getting rid of the shift will force that, some of the base running rules will force that.”

Hoyer insisted the Cubs want to compete next season. But he said that a year ago, too.

“We certainly want next season to look a lot more like our second half than our first half [this season],” Hoyer said. “And if it does, we do have a chance to be in the race and play meaningful games throughout the entire season. And hopefully, that means competing in October.”

The Chicago Blackhawks have had some good goaltenders during their run of dominance in the 2010s. With Corey Crawford as the main guy, the backup situation has been mostly good for them. One of them sticks out above the rest.

Scott Darling was the local kid that grew up a Blackhawks fan that realized his dream of playing for the hometown team. He played for the Hawks from 2014-2017 and was a very nice backup.

His role included a run in the playoffs where he relieved Corey Crawford until the time was right to put him back in. It was that same season that Darling’s name got put on the Stanley Cup with the rest of his 2014-15 teammates.

After the 2016-17 season ended, however, Darling made his way to the Carolina Hurricanes where he was expected t be the new franchise goalie. Everyone thought that he was ready to take that next step into a starter role but he clearly wasn’t.

He only lasted there for two years before finding himself out of the NHL. After a few years of playing in other leagues around the world, he finally stopped playing. Since then, he has pursued other things away from hockey. Stand-up comedy is one of the most notable endeavors.

Now, he is taking that entertainment phase to the next level. On Monday, it came out that Darling will be a new member of the pre and postgame team on NBC Sports Chicago. He will join Pat Boyle, Colby Cohen, and Caley Chelios on the set to preview/break down games all year long.

This isn’t going to be a great year for the team in terms of wins and losses but there are plenty of reasons to tune in. A guy like Darling will be perfect for breaking down why they are doing what they are doing.

As they try to develop a lot of young talent, it should be fun to watch throughout the year. They have a clear goal in mind and that is to rebuild the right way. There might be some painful moments along the way which is why it will be nice to have a guy like Darling to listen to.

Darling deserves this opportunity. He battled to get to where he was in the NHL and now it is good to see him succeeding in his post-playing days. He is the perfect person to be one of the faces of the team and it will be fun hearing what he has to say all year long.

Cubs’ Hoyer planning more ‘intelligent spending’on October 10, 2022 at 8:04 pm

CHICAGO — Jed Hoyer was encouraged by how the Chicago Cubs finished the year.

What that means going forward remains to be seen.

Speaking for the first time since Chicago completed its second straight losing season, Hoyer talked Monday about building on the team’s 40-31 finish. But the Cubs’ president of baseball operations also returned to the ambiguous concept of “intelligent spending” — which could price the big-market club out of the massive contracts at the top end of the free agent market.

“We want to build something lasting and we want to build something that we’re proud of for a long time,” Hoyer said, “and I think that you can get caught up in our game in transactions that feel really good in the short term and don’t make long-term sense. So those are the ones we’ll avoid.

“But we do want to be aggressive to capture that momentum, to fill the holes on the team that we know we have.”

While Hoyer left himself miles of wiggle room when it comes to the team’s offseason plans, he did confirm the club would make a qualifying offer to Willson Contreras. The All-Star catcher, who helped the Cubs win the World Series in 2016, is eligible for free agency.

Contreras, 30, talked late in the year about wanting to go somewhere he was wanted, but Hoyer is leaving the door open for a possible return.

“I had a great conversation with Willson the other day. We’ve always had a really good relationship,” Hoyer said, “and I admire how he competes. … As far as his comments and things like that, I’ll take the comments he sort of makes to me directly, not those.”

Hoyer said he wasn’t ready to talk about manager David Ross’ 2023 coaching staff just yet, but he is hoping to make an announcement this week. Asked about the possibility of contract extensions for Nico Hoerner and Ian Happ, Hoyer said the club had taken what he called “first steps” with multiple players about possible deals.

“There are players that we’d love to keep in a Cub uniform for a long time,” Hoyer said. “Hopefully we can work hard on those and get some across the finish line.”

Chicago finished 74-88 this year, a three-win improvement from last season that was good enough for third in the lackluster NL Central. It was the first time that it finished with a losing record in consecutive years since a string of five in a row from 2010-14.

The season was derailed by a pair of long losing streaks: a 10-game slide in June when Chicago was outscored 90-30, and a nine-game skid in July.

But the Cubs played well down the stretch. The rotation had a 2.89 ERA after the All-Star break, third in the majors behind the playoff-bound Astros (2.70) and Dodgers (2.73). A 15-11 September was the franchise’s first winning month since it went 19-8 in May 2021.

While Hoyer enjoyed the strong finish, he acknowledged the danger of making too much of the second-half results.

“Some of what we saw in the first half was probably somewhat schedule-related, injury-related,” he said, “and similarly in the second half, we have to keep in mind that guys were able to kind of play free and easy at the end.”

When it comes to the Cubs’ offseason wish list, power for the lineup, quality innings for the rotation and a veteran bullpen presence are among the top priorities. The team might be able to find some of that power internally, with Seiya Suzuki more comfortable after transitioning from Japan to the majors and Hoerner’s continued development.

“We want next season to look a lot more like our second half than our first half,” Hoyer said, “and I think if it does, then we do have a chance to be in the race and play meaningful games throughout the entire season, and hopefully that means competing in October.”

A new report on Monday from Jay Glazer suggests that teams will now be calling the Panthers for players and one hot name will be wide receiver D.J. Moore.

The Bears have plenty of room in their budget to take on a player like D.J. Moore even with his cap hit of $6.1M. The other teams that are in competition with the Bears for the wide receiver would be the Patriots and Giants.

But there are some teams the are WR needy, that have the cap space for this year and next year when DJ Moore’s cap hit goes to over 20+ Million a year.

Can the Bears afford D.J. Moore?

In his current contract situation with the Panthers, according to Spotrac, he will earn a base salary of $1,035,000, a signing bonus of $19.5M and a workout bonus of $200,000, a cap hit of $6.1M as previously mentioned, and a dead cap value of $41,810,000. In 2023, the Panthers would have to eat about $15M in a trade, which makes things difficult for them to move him.

Moore is a proven receiver that has gone over 1,000 yards in the past three seasons. He’d be a legit WR1 with Chicago to pair along with Darnell Mooney. More importantly, it gives Justin Fields a young weapon on offense to build for the future.

Moore is a player to keep an eye on moving forward in terms of trade talks but we have to understand it is a bit of a different situation with the money.

Bears coach Matt Eberflus ‘hopeful’ Jaylon Johnson can return Thursday

Jaylon Johnson went through a workout on the field at U.S. Bank Stadium hours before the Bears played the Vikings on Sunday. The next day, Bears head coach Matt Eberflus sounded optimistic that his standout cornerback could play Thursday against the Commanders.

“We’re hopeful that he’ll be ready to go,” Eberflus said Monday.

Johnson hurt his quad during practice Sept. 22, three days before the team’s Week 3 game against the Texans. He returned to practice for the first time Friday and was listed as doubtful for the Vikings game before being ruled out 90 minutes before kickoff.

Eberflus said that he was “hopeful” at this time last week that Johnson could play against the Vikings, too. The Bears will put out a mock injury report Monday saying which players could have practiced — if they’d held one. Instead, they will have a light walk-through.

Johnson will go through a workout after the walk-through.

“We’ll see where he is,” Eberflus said.

The Chicago Blackhawks are going to be one of the worst teams in the National Hockey League this season. They have Patrick Kane and Seth Jones at the top of the roster with the potential of Jonathan Toews to have a good year.

Outside of that, the players are either mid or worse. It is one of the worst rosters in the league that could only be getting worse. If they trade any of the previously mentioned three players, they would become even worse.

Good players that were there last year like Alex DeBrincat, Kirby Dach, Dominik Kubalik, and Marc-Andre Fleury have all been sent away to different teams. Now, the idea is that they are tanking so that they can be in a position to have a really high draft pick in 2023.

The team would never admit that is what they are doing but it becomes more and more obvious as time goes on. They aren’t using prospects like Lukas Reichel or Arvid Soderblom because they don’t want them to ruin their development playing for this really bad team.

You also don’t want them to get hot and help the team win games that they have no business winning. There is a generational talent in the draft that they can get if they play their cards right and have a little bit of luck.

Chicago made a waiver claim on Monday that might help them and their tanking. They claimed defenseman Jarred Tinordi. He is a former first-round pick (2010) by the Montreal Canadiens that never really panned out.

You might remember him as a part of the trade that got John Scott out of Arizona in an attempt to get him out of the All-Star Game (he ended up going anyway). In total, Tinordi has played in 109 NHL games where he has scored two goals and 11 assists for 13 points.

It is clear that the Hawks will use him as he will help them tank. In the NHL, he might be able to help some of the younger kids that are down in the AHL as the team doesn’t want to promote them before they are ready. Developing these young defensemen is much more important.

Having Tinordi as a healthy option to skate for some minutes will help them get through the season. If he can do that for even a few games, it will be a worthy waiver claim for the Hawks. It is going to be a hard year but there is potential for a very nice reward.

Bulls guard Coby White is in for an intriguing next few months

There were some moments for Coby White in Sunday’s preseason win up North.

A plus-19 in plus/minus off the bench, a big step-back jumper to keep the momentum going early in the fourth quarter, and of course the play-making. Maybe one of White’s better play-making displays since last March.

Not only were White’s six assists needed, but they were timely in the comeback win over Toronto.

Definite moments for White, but there’s always moments for the former North Carolina product.

That’s why White’s next few months could be the most intriguing to watch on the entire Bulls roster.

White’s eligible for a rookie contract extension, but was also the most rumored trade piece the team realistically was shopping in the offseason. He’s been a much-needed three-point presence off the bench, and at the same time susceptible to bad turnovers and shaky defensive moments.

So how has the former No. 7 overall pick from the 2019 draft handled all the uncertainty this preseason? His usual way of head down, and keep working.

This past summer was the first one in years in which White could just focus on basketball, and he’s hoping it shows when the games start to count next week.

“[This offseason has] been important to me,” White said. “My first offseason was Covid, last year I tore my labrum, so it was good to just get back in the gym and focus on working on my game. I haven’t been able to do that since college. It was a good summer, and I felt like I put in a lot of work, time and effort, and hopefully this season it will translate over and I can showcase the work I put in.”

That’s where it will get interesting.

When the Sun-Times reported in July that White was in several trade scenarios but pulled off the market when the front office didn’t like the return, the Bulls were dealing from a position of strength.

Lonzo Ball’s left knee was a fluid situation, but there were no indications a second surgery would eventually be needed, Zach LaVine was a max contract recipient, Ayo Dosunmu was putting together an impressive offseason, Alex Caruso was healthy, and Goran Dragic was on radar in free agency.

To say it was a crowded guard room was an understatement.

Fast forward to training camp.

With Ball starting the regular season out of the mix, Dragic’s age, as well as the health concerns always surrounding LaVine and Caruso, White’s best ability right now could be availability.

“Worked on my body more coming into camp,” White said. “Being injured last year was hard for me, so I learned to appreciate the game more. I’m just trying to take advantage of the opportunity I have.”

Through the first three preseason games – White left the opener against New Orleans early with a leg contusion – Caruso and Dragic were the first guards off the bench in the first two games, with Dosunmu starting at the point in Ball’s absence.

Dragic sat out in the Raptors game, which gave White the early call.

Rookie Dalen Terry has shown some point guard abilities late in games, which adds another body to be juggled for backcourt minutes.

White, however, remained the best outside shooter in that second unit.

So are the Bulls poised to walk-away from that, either with an in-season trade or after the season when White could become a restricted free agent if no extension is reached?

Considering Miami reserve guard Tyler Herro just signed a four-year, $130 million extension off of his rookie contract, and has scoring numbers very similar to White, there’s some tough decisions coming.

There always seems to be with White.
